Steepleton arrested at home — Updated

ROCK CREEK, W.Va.–A Raleigh County Sheriff arrested tree sitter Laura Steepleton at her home today on failure to appear charges.  According to friends of Steepleton’s, she has been calling Raleigh County all this past week asking if she had a court date and was never told of one.

According to the Raleigh County Magistrate’s office, they have no record for Steepleton and that it’s likely a Circuit Court case, which means no news will come till open of business in the morning.

Steepleton’s arrest happened the same day that Mike Roselle and Tom Smyth, the last remaining jailed Marfork Office arrestees, were released on bail.


UPDATE:

Heard from Laura and spoke with the Kanawha Co. Magistrate’s office.  The latter said she was taken in on a capias warrant for violating the bond agreement from the DEP action.  The criminal case from her charges in that action have been completely resolved.  The magistrate’s office said that Mag. Yeager will arraign Steepleton when he receives paperwork from Raleigh County, who arrested and hold her in the Southern Regional Jail.

Roland Micklem was not the only person in court today over his opposition to mountaintop removal.  Laura Merner and Gabe Schwartzman were also in Kanawha County Magistrate Court for separate reasons. Merner was in court for the action on August 11, where she and three others locked to the doors of the West Virginia Department of Environmental Protection headquarters (initial post and video) demanding its leader Randy Huffman resign. Merner is now on probation for one year and is restricted from the State Capital and the DEP in Kanawha County, marking the first probation of the campaign.

Gabe Schwartzman had a hearing before Mag. Paris Workman for the October 10 banner-drop on Walker CAT’s headquarters, which challenged Walker’s misleading pro-coal advertising campaign. The defense attorney argued Schwartzman’s actions came from necessity to uphold the Clean Water Act, yet Schwarzman was found guilty of trespassing and fined $100.

Roland Micklem was arrested this morning for failing to appear in court for allegedly trespassing on Walker CAT property during the Senior Citizen’s March to End Mountaintop Removal. Micklem claims he never recieved a notice to appear, and he claims he never enter any marked ‘No Trespassing’ areas nor was he asked to leave while on Walker CAT property. His arresting officer, Chief D.B. Cox, mentioned other outstanding warrants but did not name those implicated. Micklem was released on his own personal recognizance and has returned to the State Capital.

Law enforcement arrested Roland Micklem today during his fast at the West Virginia Capitol on a warrant for failure to appear at an Oct. 13 summons. Trespass charges were filed against Micklem on Oct. 10 in relation to an incident at the Walker CAT office in Belle, W.Va. during the Senior March to End Mountaintop Removal.

The Kanawha County Magistrate’s office said a summons was mailed to the address they say Micklem gave an officer, but Micklem claims he never received any summons or notice that charges had been filed against him, and was never arrested on this charge.

UPDATE 2:50 p.m.: Roland was charged with trespass A on Oct. 10 and a new date will soon be set.  He intends to plead not guilty, as he did not believe he was trespassing at the time, and will be represented by Roger Forman.  If found guilty, this charge carries a maximum penalty of up to a $100 fine.
