One of Three Released, Climate Ground Zero in Need of Funds

Joe Hamsher, one of three arrested for occupying Marfork Coal Company’s main office in order to deliver a citizen’s arrest warrant to Marfork President, Christopher Blanchard, and Massey CEO, Don Blankenship, was released Thursday for a cash-only bail amount of $5,000. Mike Roselle and Tom Smyth remain in jail, held for a combined total of $12,500.

Upon release, Hamsher expressed concern for his fellow comrades still held in Southern Regional Jail and stressed the need for additional funds for the campaign. “We’ve put the pressure on Massey and they’re not making it easy, but that’s just proof we need to continue what we’re doing,” Hamsher said.

With the recent black water spill into Clear Fork River and the anniversary of the Buffalo Creek Disaster, we are reminded that neither coal companies like Massey Energy and Pioneer Fuel nor the West Virginia DEP have a history of adequately protecting public health and safety. Funds Needed for Combined $17,500 Cash-Only Bail

Joe Hamsher, Mike Roselle, and Tom Smyth locked down this morning to Marfork Coal Company, Inc.’s office in order to deliver a citizen’s arrest warrant to Christopher Blanchard, president of Marfork, and Don Blankenship, CEO of Massey Energy. Currently they are being held for a combined cash-only bail of $17,500. Though all received the same charges of conspiracy, trespass asked to leave, and obstruction, Roselle received a bail amount of $7,500 cash-only while Hamsher and Smyth both received a bail amount of $5,000 cash-only.

Please allow us to continue opposing Massey and Marfork by donating to our legal fund. Donate online through paypal or another method of your choosing.

Thank you to everyone who has already donated or loaned money, but as the campaign continues, the need for legal funds increases. Many who risk arrest in this campaign are not able to pay all the fines that they may be sentenced to after trial and some loans need to be repaid.

As Massey accuses Hamsher, Roselle, and Smyth of terrorism and endangerment, we need to remember who the real criminals are: those who endanger thousands of lives by allowing the Brushy Fork impoundment to remain in violation of over 100 documented permit infringements. 8 Activists Arrested at Kayford Mountain Lock Down

Kayford, WV — Eight activists with a coalition of groups including Mountain Justice and Climate Ground Zero walked on to the Patriot Coal mountaintop removal coal operation on Larry Gibson’s Kayford mountain in the early morning hours of March 23, 2009. Six of the protestors locked themselves, in groups of three, to a piece of massive earth moving equipment–referred to as a Yuke–with tires 24′ tall and hung a banner reading “Never Again” on the machine. The activists locked down for five hours. Ten officers from three different state and county authorities responded to the protest on Kayford, the largest number of people to be arrested during this sustained campaign of non violent civil disobedience that began in February, 2009.

The eight activists arrested include Kim Kirkbride, Ash-Lee Henderson, Tanya Turner, Jared Story, Willie Dodson, Will Wickham, Mathew Louis-Rosenberg, and Glenn Collins.

The activists were arrested and taken to Boone County seat at Madison, were processed and released on their own recognizances.

Three state authorities arrived on the scene: 6 Kanawha Sheriffs, 2 Boone County sheriffs and 2 WV state troopers. Rock Creek, WVa — Yesterday morning State Trooper Bowers pulled up in front of our Rock Creek office and honked his horn. He doesn’t usually come to the door. “How can I help you?” I ask.

“Sgt Smith wants you to meet him at 1:00 at his office in Whitesville” he says.

“Can you tell me what this concerning?”

“No” Officer Bowers replies, and slowly drives off.

In Sgt. Smith’s office I am informed that the Magistrate has put out an arrest warrant on me and that he will have to take me into custody and drive me to Beckley. After a short conversation, we agree that I can surrender myself the next day at 9:00 AM in Beckley and I went home.

This morning at nine I met Sgt. Smith at the State Police headquarters and was fingerprinted and taken into custody. He drove me to the Magistrate’s office where I met Mr. Massie in the lobby. When he saw me he said to Sgt. Smith, “I’d be happy to put him in the holding cell.”

He gave the keys to Sgt. Smith and he locked me up in the holding cell with one other poor fellow chained at the waist and foot. I said down on the cold steel bench and waited for my chance to see the Magistrate.

Sgt. Smith unlocked the cell door 10 minutes later and took me to see Massie.

Massie immediately began to scold me for missing my last scheduled appearance in front of him and laid down the law: $500 bond, no contact with Massey Energy, no leaving the state, bla, bla, bla… I said “Your Honor, I cannot accept these conditions”.

“Then you’re going to jail” he replied, and Sgt. Smith put handcuffs on me and the Magistrate left the chambers.

Twenty five minutes later Massie returns with a slip of paper in his hand and without looking at me asks again, “So, you’re not going to sign this release?”

“No sir, I cannot.” That was my final answer. Then things happened very quickly. Massie hands me and Officer Smith a copy of Judge Kirkpatrick’s order to release me with a warning not to do anything prohibited in the order or I would face arrest. Then he turned quickly and exited his chambers.

I did not get a chance to reply.

Sgt. Smith motioned with his key so I held my hands up and he retrieved his handcuffs. Then he left through the back door and I was standing in an empty courtroom holding a piece of paper.

I ask you, is this justice.

Arrest warrant issued for Roselle

Rock Creek, WV — The Raleigh County Court issued a warrant for activist Mike Roselle this morning. Roselle has agreed to turn himself in at the State Police office in Beckley tomorrow morning at 9:00 AM.
